What is Conveyancing?

Conveyancing is the legal process of transferring ownership of real estate from one person or entity to another. It is legally required for both buying and selling land. This process means preparing, verifying, executing and lodging the numerous legal documents required for sale and purchase to take place.


What is a Conveyancing Paralegal?

In Queensland conveyancing is carried out by either a conveyancing paralegal or a solicitor whom specialises in it. They ensure their client both meets all legal requirements and that their interests are protected. They are responsible for the settlement and title transfer process.


When do you need a Conveyancing Paralegal?

If you are purchasing or selling property or updating a title you will need a conveyancing paralegal or solicitor.


What does a Conveyancing Paralegal do?

A conveyancing paralegal has many tasks, however the simplest explanation of their role is this; they prepare, execute, verify and lodge the legal documents required for the purchase or sale of property to take place. They will also attend settlement of the property.

During the purchasing process a conveyancing paralegal will draw up documents such as the Contract of Sale, and will conduct searches on the property. They will also attend to the preparation of settlement. They will handle the calculation of rates, water and taxes. They will ensure all transfer documents are completed correctly so that property is rightfully and legally transferred.

During the sale of a property a conveyancing paralegal will represent you in dealings such as requests to extend dates and preparation for settlement. They will prepare the Contract of Sale and ensure any special conditions are included. A conveyancing paralegal or solicitor also manages the settlement of a property sale. This means they coordinate the bank, final payments between parties and liaise with the real estate agents with regards to the handing over of keys to the property.
